A family can agree that an apartment should belong to a spouse or child and still be some distance from completing the legal transfer. The difficult part is often not the agreement itself. It is making the ownership record, relationship evidence, valuation and transaction category describe the same arrangement.

This guide concerns Dubai property gift registration, rather than purchasing a home or administering an inheritance. Official service information was checked on 5 November 2026. The preparation frameworks and scenarios below are editorial analysis: they help organise a conversation with the registration trustee and advisers, but do not determine whether a particular transfer will be accepted.

Establish whether the arrangement is actually a gift

DLD describes its service as transferring all or part of a property without compensation. Its published scope names parents, spouses and children, and also references companies, subject to restrictions concerning the property. Do not assume that any relative or any company structure qualifies merely because no cash changes hands.[1]

Start with a written description in ordinary language: who owns the asset now, who should own it afterwards, what share is changing, and whether anyone receives money or another benefit. This paragraph is useful precisely because it exposes ambiguity. A payment settling a family debt, the transfer of another asset in exchange, or an undertaking to reimburse the donor can make an apparently simple explanation incomplete.

Ask the trustee to confirm the transaction category against the actual facts. A service name selected to obtain a lower quoted charge is a weak foundation for an ownership change. The documents should reflect the substance of the arrangement.

Separate a lifetime gift from succession planning

An immediate ownership transfer and a plan for what happens after death solve different problems. DLD publishes a separate inheritance-registration service, whose fees and documentary context should not be confused with an ordinary lifetime gift.[2] If the purpose is succession, obtain advice on whether the proposed transaction matches that purpose before arranging certificates or paying intermediaries.

Build a relationship and identity file

The gift service lists identity evidence and relationship documents. For foreign marriage and birth certificates it specifies translation and attestation requirements, alongside additional kinship evidence. A representative needs a legal power of attorney. Companies not already registered require the relevant registration procedure.[1]

Those requirements deserve an individual document review rather than a checklist copied from a friend. Ask which version of each certificate will be accepted, whether the names match the ownership and identity records, and what translation and authentication sequence applies to the country that issued it.

A useful preparation table is:

File component Question to resolve before booking Evidence to retain
Current ownership Does the property reference match the intended asset and share? Current record and transaction reference
Donor and recipient Are identity names consistent across all documents? Valid identity documents and discrepancy explanation
Relationship Does the certificate prove the relationship required for this route? Accepted certificate and authentication trail
Representation Does the authority cover this particular transaction? Reviewed power of attorney and identity of representative
Intended result Who should appear on the final record, and in what proportions? Written instructions confirmed by the parties

This is a planning aid, not a replacement for the authority’s required-document list. Keep originals secure and share copies only through a verified professional or official channel.

Confirm the property position before estimating costs

A family transfer does not make the asset’s existing obligations disappear. Before discussing price, identify whether there is financing, a restriction, a developer-related process or another circumstance that could affect the transaction route. Obtain the relevant party’s written answer rather than treating an informal statement that the apartment is “clear” as sufficient.

For mortgaged property, ask the lender and trustee to explain the sequence and permissions applicable to the proposed gift. Do not import Dubai sale-and-mortgage procedures into a gift without confirmation. DLD’s mortgage-release service is a distinct procedure, involving lender documentation and registration outputs.[3] Whether it is necessary in a particular case is a question for the actual transaction file.

Also ask who is authorised to request the valuation and whether the property identification used for that valuation is identical to the identification used for registration. Small inconsistencies become costly when one document describes a building, another a unit and a third an ownership share.

Understand the percentage without mistaking it for the total

The Dubai legislation portal records a gift-registration charge of 0.125% of property value, with a minimum of AED 2,000.[4] DLD’s service page also lists document, map and partner charges. Its partner-fee wording refers to “sale value” despite appearing on a gift page; confirm how that component applies to your gift rather than silently treating it as settled.[1]

The Dubai legislation portal separately records the gift fee and the minimum. It also lists a different percentage for registering a sale contract, reinforcing why the legal category matters.[4]

Consider two purely hypothetical valuations, used only to illustrate the published main-fee formula:

Assumed valuation Percentage calculation Main registration fee after minimum
AED 1,000,000 AED 1,250 AED 2,000
AED 3,000,000 AED 3,750 AED 3,750

Neither line is a complete quote. Add only charges confirmed for the actual transaction, with their basis and VAT treatment stated. Distinguish official registration, valuation, issued documents, service-partner work, translation, attestation and professional advice. Ask who receives each payment and what deliverable it purchases.

An itemised quotation is more useful than a headline assertion that gifting costs a certain percentage. It also helps compare proposals fairly when one includes document preparation and another covers only the registration appointment.

Organise the transaction as a sequence of decisions

A practical workflow starts before submitting the application:

  1. Write the intended ownership result and disclose any compensation or connected arrangement.
  2. Confirm eligibility and the correct registration route with the trustee.
  3. Resolve property restrictions, financing and any necessary permissions.
  4. Obtain a reviewed document list specific to the parties and issuing countries.
  5. Confirm the accepted valuation and obtain an itemised quotation.
  6. Check the final application details before authorising payment or signature.
  7. Retain receipts and inspect the issued ownership documents.

DLD describes a trustee-centre application and electronic delivery of the resulting documents.[1] Preparation, external approvals and document correction are separate from the service counter’s processing estimate. Do not schedule dependent commitments on the assumption that a published service time includes every preceding task.

A family scenario: transfer the share, not just the intention

Suppose a parent wishes to give a child a defined share in a Dubai apartment. The family agrees on the principle but has not recorded whether the parent will retain the remaining share or expects the child eventually to sell it. Those unanswered questions affect the quality of the decision even before the registration route is considered.

Prepare two records. The transaction record states the precise share to be transferred and the documents needed to implement it. The family-decision record states the practical expectations: use of the home, contribution to costs, access to records and what should happen if circumstances change. Have a qualified adviser identify which expectations need legal documentation and which cannot safely remain informal.

This does not create a universal co-ownership agreement. Its purpose is to prevent the family from believing that a change of names automatically resolves every future decision. Ownership, occupation and payment responsibilities should each be understood.

Check the result after registration

Compare the issued document against the approved intention: party names, property reference, type of right and ownership proportions. Retain the valuation reference, application number, payment receipts and all permissions with it.

Then identify the operational records that may need attention. Ask the relevant manager, service provider or adviser whether their record should change, what proof they require and who is responsible for making the request. Do not assume one registry transaction updates every external relationship.

Questions families should ask before proceeding

Can a sibling use the same gift route as a spouse?

Do not infer eligibility from the everyday meaning of “family.” The published service specifically names particular relationships. Present the actual relationship to DLD or its trustee and obtain the applicable route before spending on documentation.[1]

Is the fee based on the amount the family chooses to write down?

The published gift formula refers to property valuation. Ask how the accepted valuation will be established for the asset and transfer share. A private family estimate is not a confirmed registration assessment.[1]

Does gifting guarantee a residence outcome?

Do not combine ownership registration with a visa promise. Any immigration application has its own evidence and eligibility assessment. Review the residence question separately with the relevant authority.

What should stop the appointment?

Pause if the parties disagree about the intended share, if a representative’s authority is unclear, if relationship documents have not been accepted, or if a material financing question remains unanswered. Resolving these issues before submission is usually more useful than trying to explain them after payment.
