A professional in Ras Al Khaimah may receive a salary, perform independent consulting work, hold investments and own a rental property. All four activities can produce bank credits, but treating the total bank balance as the corporate tax test creates the wrong question. The first task is to establish who earned each amount, in what capacity, and from which activity.

For individuals, corporate tax is a business classification exercise before it becomes a calculation. This guide concentrates on that classification and the evidence needed to support it. It does not replace an assessment of a particular investment arrangement, company or cross-border structure. Examples are hypothetical and assume the classifications stated in them have been independently established.

Begin with the natural-person test

The FTA states that a natural person falls within corporate tax when conducting business or business activities in the UAE and total turnover from those activities exceeds AED 1 million within a calendar year. Wages, qualifying personal investment income and qualifying real estate investment income are excluded from the business-activity test. Someone with no such business activity, or business turnover not exceeding that threshold, should not register on that basis.[1]

“Natural person” concerns an individual. It does not turn a separately incorporated company into the same taxpayer as its shareholder. Before classifying the income, identify the contracting party. Was the work performed by the individual’s sole establishment, by an incorporated company, or in employment? The invoice heading and bank account are useful evidence, but neither should substitute for reading the actual arrangement.

Write the answer in ordinary language. “I own the company” is not enough. Record who signed the customer contract, who supplied the work and which person is entitled to the revenue. If those records conflict, resolve the conflict before applying a threshold.

Do not confuse turnover with take-home profit

The AED 1 million test concerns turnover from business activity, not the amount left after expenses. A consultant may spend heavily on subcontractors and still cross the turnover test. Equally, the test should not be run by adding unrelated excluded income simply because it enters the same bank account.[1]

A good working sheet has separate columns for classification and amount. Calculate only after reviewing the classification. Otherwise a spreadsheet can produce a mathematically accurate total of the wrong inputs.

Receipt or record First question Evidence to examine
Employment salary Is this paid under an employment relationship? Contract, payroll records and employer information
Consulting invoice Which person carried out the business activity? Customer contract, invoice and business records
Investment distribution Does the personal investment definition apply? Ownership, activity and licensing facts
Property rent Does the real estate investment definition apply? Ownership and the nature of the property activity
Transfer between own accounts Is this new income at all? Matching outgoing and incoming bank entries

The last row illustrates an accounting control, not a separate exemption. A movement of previously recorded money should be identified so it is not mistaken for another sale. A bank-credit total without reconciliation can count the same economic receipt more than once.

Personal investment is a defined category

The FTA guide explains that personal investment income concerns investment activity in an individual capacity, neither conducted through nor requiring a licensing-authority licence, and not treated as a commercial business under the Commercial Transactions Law.[2] Calling an account a “personal portfolio” does not establish that those conditions apply.

Ask what is actually happening. Is the person investing their own assets, providing services to others, operating under a commercial arrangement or conducting an activity requiring permission? A description chosen for marketing or convenience should not replace analysis of those facts.

For an uncertain activity, prepare a short question for a qualified adviser: describe the instruments, counterparties, frequency, contractual capacity and any licence. Attach representative documents. Asking “Is investment tax-free?” omits the details that could decide the answer. A narrower question produces advice that can be matched to the actual activity.

Examine property income in its own context

The FTA publishes a separate real estate investment guide for natural persons and identifies qualifying real estate investment income among the excluded categories.[3] That does not justify excluding every amount connected with property. Owning an asset, earning a brokerage fee and conducting a licensed property business are different activities.

Build the property file around the activity rather than the word “rent”. Identify the owner, contract, operator, services supplied and licensing position. Keep income earned by an incorporated property company separate from the individual’s assessment. Where services or multiple operating arrangements are involved, ask for a written classification rather than copying the treatment of a conventional passive tenancy.

This article does not assume every landlord or short-stay operator has the same tax result. The useful question is whether the actual income meets the relevant definition, and which facts support that conclusion. The difference is especially important when a person owns property while also earning professional fees in the real estate sector.

Aggregate business activities before drawing the conclusion

The FTA’s test refers to total turnover from business or business activities.[1] A fragmented review can miss the threshold if each activity is examined in isolation. Create an inventory of the individual’s activities before building the calendar-year total.

For example, an individual might operate two service lines under different commercial names. Review the legal position of each arrangement and then determine what belongs in that individual’s business-turnover calculation. Do not assume a separate email address, payment channel or brand creates a separate natural person.

Keep a monthly reconciliation with a year-to-date total and a description of material changes. This makes an approaching threshold visible before the final month. It also allows an adviser to spot a classification error while the underlying contract and people are still available to explain it.

A hypothetical mixed-income example

Assume an individual has AED 420,000 of salary, AED 900,000 of correctly identified business turnover and AED 150,000 of income that has been established to meet the personal investment definition. Under those assumptions, the relevant business turnover is AED 900,000, not the sum of all three categories.

Now suppose the same person earns a further AED 180,000 from another business activity during that calendar year. The hypothetical business total becomes AED 1.08 million. The presence of salary does not itself change that calculation, and business expenses do not turn turnover into a net-profit threshold.

The illustration is a threshold exercise, not a tax bill. Crossing a registration threshold and calculating taxable income are separate stages. Expenses, adjustments and any available relief must be assessed under their own rules rather than inserted into the turnover test as a shortcut.

Translate the conclusion into a compliance calendar

The FTA’s registration guidance states that a natural person whose relevant annual business turnover exceeds AED 1 million must register by 31 March of the following calendar year. Its published example separates registration from filing, with the return due by 30 September for the preceding calendar-year tax period.[4]

For a person first crossing the threshold in 2026, that framework points to registration by 31 March 2027 and the corresponding annual filing timetable. Confirm the applicable position and portal requirements before acting. Someone who crossed in an earlier year should investigate that earlier obligation now rather than treating the next March as a reset.

Assign a person to maintain the calendar, obtain missing records and respond to requests. Outsourcing preparation does not make an unmonitored deadline safe. Keep the submission acknowledgement, the approved registration and the subsequent filing task together so registration does not become the last completed step.

Keep VAT and corporate tax assessments distinct

This guide does not determine whether an individual must register for VAT. A corporate-tax conclusion about excluded personal investment income is not a substitute for analysing supplies under VAT rules. Likewise, holding a VAT registration does not establish that every receipt belongs in the corporate-tax business-turnover test.

Maintain a separate conclusion for each tax, even when both use the same accounting records. Label the period and person in each calculation. This reduces the risk that an accountant inherits a spreadsheet with a correct number but no explanation of what that number was meant to test.

Questions to answer before the year closes

Does being employed remove business obligations?

Employment and independent business can coexist. Review the business activity separately rather than assuming a salary settles the entire tax position.[1]

Is AED 1 million a profit allowance?

No. The natural-person entry test is based on relevant turnover. The tax calculation is a later exercise.[1]

Can I classify an unfamiliar receipt myself?

Start by collecting the contract and explaining the activity. Where the definition remains uncertain, obtain an assessment tied to those documents. Recording uncertainty is more useful than hiding it inside a broad “other income” category.

What should the final annual file contain?

Retain an activity inventory, income classification sheet, reconciliation, material supporting contracts and any advice resolving uncertainty. Another reviewer should be able to reconstruct the conclusion without relying on the founder’s memory. That is the practical standard for a defensible year-end decision.
