Leaving a job involves two different calculations: what the employment relationship owes you, and how long your household can operate while the next income stream becomes reliable. Confusing them creates avoidable pressure. A large gratuity estimate can feel like available savings before the employer has reconciled service dates, leave, salary and any lawful deductions. A final settlement can also include several amounts that have nothing to do with gratuity.
This guide explains the standard statutory calculation for an eligible foreign full-time worker under the federal private-sector employment regime. It then develops an original reconciliation method for employees and smaller employers. The examples are hypothetical, including the Fujairah employer used below; they do not describe an actual case or promise an individual entitlement. Sources were checked on 1 November 2026. This is a reference guide to existing rules, not an announcement of a new benefit.
Establish the employment regime before using a calculator
Start with the employer's legal identity, the contract and the authority responsible for the employment relationship. Government employment, domestic work and arrangements governed by separate employment systems require their own analysis. A company address alone cannot establish the correct rules. The UAE government's employment-law overview identifies Federal Decree-Law No. 33 of 2021, as amended, as the federal private-sector framework. [1]

For a foreign full-time employee within that framework, the government's gratuity summary requires at least one year of continuous service, excludes unpaid absence from the service calculation and uses the final basic wage rather than allowances. Eligible fractions of a year are proportionate. The standard rate is 21 days per service year for the first five years and 30 days per year thereafter, subject to the statutory two-year-wage ceiling. [2]
Before entering numbers, ask payroll whether the worker participates in an approved alternative end-of-service savings arrangement. The Ministry's employer guide describes a system involving employer contributions to approved investment funds. That needs a separate reconciliation rather than blindly adding a full conventional gratuity calculation for the same covered period. [3]
Separate basic salary from the total monthly package
Imagine an employee receives AED 10,000 each month, comprising AED 6,000 basic salary and AED 4,000 in allowances. Using AED 10,000 as the gratuity input would produce a materially different estimate. The practical starting point is the supported basic-wage figure, not a remembered monthly bank transfer.
Build a small evidence file: the signed contract, recorded amendments, recent payslips, the payroll breakdown and the proposed last employment date. Compare them before discussing the final number. If the documents disagree, the first task is to resolve which figure is legally applicable; averaging several inconsistent figures is not a defensible substitute.

This distinction also matters for employers. A settlement spreadsheet should name each input and identify its source. A column labelled merely “salary” is ambiguous. Rename it “final monthly basic wage used for statutory gratuity estimate” and keep total monthly remuneration in a separate column. Clear labels prevent a later reviewer from inheriting an unnoticed assumption.
Worked examples across the five-year boundary
For a straightforward monthly-paid illustration, divide the monthly basic wage by 30 to obtain the daily basic-wage input. Assume AED 6,000 basic salary, uninterrupted qualifying service and no alternative-scheme complications. These deliberately simplified examples illustrate the rate structure; payroll must reconcile actual dates, unpaid absences and the applicable ceiling before approving a real payment.
| Hypothetical qualifying service | Illustrative calculation | Estimated gratuity |
|---|---|---|
| Three complete years | AED 200 × 21 days × 3 years | AED 12,600 |
| Five complete years | AED 200 × 21 days × 5 years | AED 21,000 |
| Seven complete years | AED 200 × [(21 × 5) + (30 × 2)] | AED 33,000 |
The seven-year case shows the central point: crossing five years does not retroactively apply the higher rate to every year. The first band remains separate from the later band. A spreadsheet should display both bands rather than hide them inside a long formula.
For a partial year, preserve the actual qualifying period and the method used to convert it into a proportion. Do not round a service anniversary upwards merely because the resignation occurred close to it. Ask the preparer to show the dates and the fraction explicitly. That makes a disputed estimate easier to investigate without arguing over a mysterious total.

Audit service dates and unpaid absence
Service records deserve as much attention as salary. Assemble the recorded start date, the final employment date, the notice arrangement and an absence ledger. Distinguish approved paid leave from unpaid absence instead of subtracting every day the employee was physically away from work.
Consider a hypothetical Fujairah trading company whose departing employee has several years of service and a period of unpaid leave. The employee's calendar-based estimate may differ from payroll's qualifying-service estimate. Neither party resolves that difference by repeating the headline rate. They need the absence record, its classification and a calculation showing the effect on service.
If the proposed last date changes during handover, version the calculation. Preserve the earlier draft and produce a revised one with the reason for the change. This is a recommended administrative control, not a statutory requirement to use a particular form. Its value is straightforward: both sides can see whether the total changed because of time, wages, an omitted payment or a deduction.
Gratuity is one line within a wider settlement
Build the settlement as a reconciliation, not a single transfer request. Suggested lines include unpaid salary, gratuity, unused annual-leave compensation where due, any contractual amounts requiring assessment, authorised deductions and the resulting net payment. Each line should show a calculation and supporting evidence.
Article 53 sets a fourteen-day period from the end of the contract for wages and other entitlements payable under the law, implementing decisions and contract. [4] Record the actual contract-end date and payment status rather than treating an unsigned draft as proof of settlement.
Ask what each deduction represents, the amount claimed and its basis. A vague description such as “company expenses” cannot be checked meaningfully. Likewise, an employee should disclose relevant advances and return obligations rather than presume that a positive gratuity estimate cancels every other issue. An itemised record helps identify agreement and disagreement separately.
A practical review meeting before the last working day
Request the draft while there is still time to correct factual errors. Work through the entity, regime, employment dates, basic wage, qualifying service, alternative-scheme participation and each settlement line. Then confirm how the final calculation and payment evidence will be provided.
Use a short exception list. For example: one salary amendment remains unmatched to payroll; two leave entries need classification; the final expense claim is awaiting receipts. Give each exception an owner and a next step. This is more effective than sending a broad message saying that the settlement “looks wrong”.
Keep employment settlement, work-permit cancellation and residence planning as connected but separate workstreams. A payment calculation does not itself establish immigration status. If the departure affects family sponsorship, housing or a new employer's onboarding, map those dependencies early and verify the relevant procedures independently.
Questions employees actually need answered
Is the amount in an online calculator a confirmed entitlement?
No. It is a result produced from selected assumptions. Check the legal regime, service record, basic wage and whether another end-of-service system applies. A transparent estimate is useful for discussion; it is not the same as a reconciled settlement.
Does a higher monthly package always produce a higher gratuity?
Compare the basic-wage component used for this calculation, not only the headline package. Two packages with the same total can have different documented basic-wage figures. Any disagreement about the applicable wage requires examination of the actual employment record.
What should happen if part of the settlement is disputed?
Identify the disputed line, request the calculation and evidence, and preserve correspondence. Seek guidance from the competent employment authority on the appropriate route for that relationship. Avoid signing a factual acknowledgement that says money was received if it was not.
Turn an estimate into a usable transition plan
For household planning, keep three numbers: the gross estimate, the reconciled amount and the amount actually received. Budget essential commitments against verified resources and realistic payment timing. For the employer, a clean settlement protects continuity by ending the relationship with traceable records rather than unfinished assumptions. The useful achievement is not an impressive calculator result. It is a number that both parties can understand, substantiate and reconcile to payment.
