Annual leave becomes difficult when three different questions are treated as one: how much leave has accrued, when it can be taken and how any payment should be calculated. An employee may have a recorded balance but no approved dates. A manager may have agreed a holiday informally while payroll uses different dates. At departure, both sides may discover that the leave ledger does not match the final settlement.

A useful leave system makes those distinctions visible. This guide explains the federal private-sector framework and offers an original planning method for employees and smaller employers, including a hypothetical Sharjah team. It was source-checked on 1 November 2026. The practical templates and examples are editorial recommendations; they are not a prescribed government form or an assessment of a reader's individual employment rights.

Identify the applicable employment system first

Check the employer's legal identity and the contract before applying a general leave summary. Government employment, domestic work and employment governed by separate legal systems need their own rules. Do not infer the regime from the building, job title or company branding.

The UAE government's overview identifies Federal Decree-Law No. 33 of 2021, as amended, as the federal private-sector framework. [1] A contract or company policy may offer a more favourable arrangement, but the employee should understand how it is written and recorded. Ask HR for the actual policy version rather than relying on a colleague's experience from another employer.

Create a short employment record containing the start date, work pattern, leave year, approved policy and payroll contact. That record makes later questions specific: “Which dates count in this approved period?” is easier to resolve than “How does leave work in the UAE?”

Understand the statutory entitlement without assuming approval

The government summary states 30 days of fully paid annual leave after one year of service, and two days per month where service exceeds six months but is under one year. It separately recognises proportionate entitlements and part-time arrangements. [2]

An entitlement is not the same as a confirmed holiday booking. Article 29 provides for scheduling according to work requirements and agreement with the employee, with notice of the specified date at least one month ahead. It also addresses holidays falling within leave and payment for unused leave at termination. [3]

In practice, record the request date, proposed period, decision and any agreed changes. A shared calendar entry can help colleagues plan, but it should not be the only evidence of approval. If a manager changes teams or leaves the business, an employee should not have to reconstruct an arrangement from memory.

Calendar days, working patterns and the leave ledger

Never assume that “30 days” and “30 working days” mean the same thing. Read the applicable rules and the actual contract or policy. Clarify how weekends, public holidays and any more favourable company arrangement are treated before deciding how many days a trip will consume.

The purpose of a leave ledger is to reproduce the decision, not merely display a reassuring balance. It should identify the opening balance, new accrual, approved leave taken, any adjustment and the resulting balance. Adjustments need a reason and an approver. A manually overwritten total without history is difficult to defend or correct.

Ledger field What it should make clear Common error to avoid
Service and leave-year dates Which period is being measured Mixing calendar year with service year
Work pattern The arrangement being assessed Applying a full-time assumption automatically
Approved absence dates The actual period authorised Counting a requested trip as approved leave
Days charged How the period reduces the balance Using a different counting convention without explanation
Adjustment record Why a balance changed Erasing the history behind the total

This is a suggested control structure. Employers can implement it in payroll software or a simple controlled spreadsheet, provided that the calculation and changes remain understandable.

Leave salary and unused-leave compensation are different questions

The legal text provides for wage during annual leave and refers to basic wage when calculating unused accrued leave at the end of employment. [3] That distinction matters when a monthly package contains basic salary and allowances. An employee should not apply the termination calculation indiscriminately to an ordinary paid holiday.

Suppose a hypothetical employee's monthly remuneration comprises AED 5,000 basic wage plus allowances. Before approving a final settlement, the employee and payroll should identify the legally due unused days and the relevant payment basis. Multiplying the number of days by whichever monthly number happens to be easiest to find is not a reliable method.

For an ordinary leave period, ask payroll how salary will appear in the relevant month and whether any advance or adjustment is being processed. For a termination payment, ask for the separate unused-leave calculation and supporting balance. Clear descriptions prevent a transfer labelled “leave salary” from concealing two entirely different transactions.

Carry-forward needs a decision and a record

Do not treat an unused balance as automatically available forever. The implementing regulations published with MOHRE's legislation provide for carrying forward no more than half of annual leave to the following year, or agreeing a cash allowance in lieu, and distinguish the payment basis during employment from basic-wage compensation at termination. [4]

Before the leave year ends, ask HR to identify what will be taken, what is proposed for carry-forward and what approval is required. Where the policy offers more favourable terms, record how those terms apply to the employee. Avoid a last-minute message telling everyone that unused days simply disappear without checking the legal and contractual position.

The management objective should be genuine time away as well as accurate accounting. A continuously growing balance can signal a staffing or delegation problem. Paying attention to that operational cause is more useful than repeatedly postponing every request and relying on a year-end spreadsheet to resolve the consequences.

Hypothetical Sharjah team: coverage without permanent postponement

Imagine a small Sharjah services business with four employees sharing customer work. Two request overlapping leave during a busy period. The manager first checks the requests, accrued entitlements and policy. Then the team identifies which duties need live coverage and which deadlines can move.

A practical plan might include written handover notes, a named backup for each client and a clear escalation route. The manager discusses viable dates with the employees and records the agreed outcome. The example does not establish a right to a particular requested week; it illustrates how to make a scheduling decision transparent rather than personal.

The business also reviews whether the same employee is repeatedly unable to take leave because only that person knows a critical process. If so, the next action is training a backup. The leave issue has revealed a continuity weakness. Solving it improves both the employee experience and the company's ability to operate through illness, turnover or an emergency.

A useful employee checklist before booking travel

Confirm the approved dates and the days that will be charged. Check the ledger balance and the payroll treatment. Verify the return-to-work date, especially when a trip crosses weekends or public holidays. Keep the written decision accessible.

Then review the dependencies outside employment: passport and residence validity, family travel documents, school commitments and any destination requirements. Employer approval does not resolve immigration or airline-document issues. If the trip is likely to become an extended absence, investigate the relevant residence implications separately before departure.

Prepare a concise handover that names ongoing tasks, deadlines and people authorised to act. Avoid sending sensitive client material to personal accounts merely to remain available. Agree what genuinely requires contact during leave and who handles ordinary questions. This is an operating recommendation, not a claim that every job can be entirely disconnected in the same way.

Questions to ask when the record does not look right

My portal shows a balance. Does that mean my dates are approved?

No. A balance and a scheduling decision are separate records. Ask for confirmation of the actual requested period before making commitments that depend on it.

Are public holidays always extra days outside annual leave?

Do not assume that. The legal framework addresses holidays that fall within annual leave, and a more favourable contract or policy may affect treatment. Ask payroll to show the applicable counting method for the specific period.

What if I leave before using the balance?

Request a reconciliation of legally due unused leave and its payment basis as part of the final settlement. Check the dates and ledger rather than relying on an unexplained total copied from a portal.

What should I do about a discrepancy?

Identify the disputed entry, attach the relevant approval or payslip, and ask HR for the calculation. If the issue remains unresolved, seek guidance from the competent employment authority. Keep the question factual so that the next reviewer can reconstruct it.

Make the balance understandable before it becomes urgent

A good annual-leave process is modest: a clear entitlement record, a visible approval, an accurate ledger and a payment explanation appropriate to the transaction. Employees gain confidence in planning time away. Employers gain predictable coverage and fewer settlement surprises. The most useful improvement is to review those records while everyone is still working together, rather than waiting until a flight, resignation or payroll deadline makes every missing detail urgent.
