An overtime disagreement usually starts before payroll. A manager says a task is urgent, a worker stays late, and neither side records whether the extra time was requested, which hours it covered or how it should be classified. By the time a payslip arrives, the discussion has become a dispute about money built on a dispute about facts.

This guide addresses ordinary UAE private-sector employment under the federal labour framework. A warehouse team in Ajman provides the hypothetical examples, but the method is useful elsewhere in the Emirates. It does not assume that every employee, free-zone arrangement or work pattern has identical overtime treatment. Sources were checked on 5 November 2026. The evidence tables and examples below are editorial planning tools, not a determination of an individual claim.

Start with the employment framework and the actual roster

The UAE Government identifies normal private-sector working hours as eight daily or 48 weekly, while recognising sector and worker-category variations. Its guidance also distinguishes breaks and ordinary commuting from working time. A period spent at the workplace therefore needs classification before it becomes a payable overtime figure.[1]

Start a review with three documents: the employment contract, the applicable working-time policy and the roster for the period in dispute. Ask the employer to identify any exclusion or special rule it believes applies to the employee. A job title alone is a poor substitute for identifying the legal treatment of the actual role.

Keep two questions separate: what hours were lawfully scheduled, and what remuneration is due for qualifying work actually performed? Paying an overtime amount is not a reason to ignore working-time controls. Equally, a vague concern about the roster does not supply the missing pay calculation.

Classify the time before applying a percentage

Article 19 of the federal labour law provides for ordinary overtime at normal hourly remuneration calculated using basic wage, with an increase of at least 25%. For qualifying overtime between 10 pm and 4 am, the increase is at least 50%; the night provision excludes shift workers. The law separately addresses work on a contractual rest day, allowing another day off or the applicable day's wage plus at least 50% of basic wage for that day.[2]

Question Useful evidence Reason to keep it separate
What was the scheduled finish? Approved roster and later amendments An early start or changed shift may alter the comparison
What extra work was required? Instruction, task log and completion record Presence alone does not explain the work
When did it happen? Start and finish timestamps Night periods cannot be reconstructed accurately from a monthly total
Was it a contractual rest day? Contract and published rota Rest-day treatment is a separate question
Is an exclusion asserted? Written explanation of role and rule A generic label does not settle eligibility

Do not combine every late departure into one number labelled “overtime”. Separate ordinary additional hours, potentially relevant night hours and rest-day work. Where categories overlap, obtain the employer's stated treatment or qualified advice rather than adding percentages together yourself.

A worked example with explicit assumptions

Suppose an Ajman business and its employee have confirmed that AED 20 is the relevant basic hourly rate for this illustrative calculation. Assume the employee is eligible, the extra work was required, and no special exclusion applies. The example starts with an agreed hourly basis; it does not prescribe a universal monthly-salary divisor.

For three qualifying ordinary overtime hours, the illustration is AED 20 × 1.25 × 3 = AED 75. For two qualifying overtime hours in the specified night period, and assuming the night rule applies, it is AED 20 × 1.50 × 2 = AED 60. These are total payments for the qualifying hours, including their basic hourly component, not merely the premium added to a second payment for the same hours.

The arithmetic is easy. The difficult part is establishing the inputs. A worker paid a monthly package should ask payroll to show the basic-wage component and explain the hourly conversion it has applied. Housing, transport and other package components must not silently be substituted for the statutory basic-wage basis.

A different hourly basis produces a different amount. If the parties disagree about the conversion, preserve both calculations and the reason for the difference. A spreadsheet should expose an assumption, not disguise it as law.

Build an overtime register that can be reconciled

Use one line per work event. Record the date, planned hours, actual additional period, breaks, task, requesting manager, approval reference, proposed classification and payroll result. Keep original time records rather than repeatedly editing a single summary after the fact.

For a small business, a shared register can be simpler than a complicated system nobody maintains. A practical process gives workers a way to flag discrepancies promptly and gives supervisors a clear responsibility to confirm or challenge entries. Record a correction as a correction, with a date and reason.

For employees, preserve records lawfully. Keep your own contract, payslips and communications addressed to you. Do not copy customers' databases, confidential files or unrelated colleagues' personal records to prove a small number of extra hours. The evidence should be proportionate to the issue being raised.

Distinguish authorisation, emergencies and recurring understaffing

The official framework ordinarily limits additional hours to two per day, with exceptions governed by the implementing rules. MOHRE's working-hours guide also states the statutory 144-hour limit over three weeks and restrictions on consecutive rest-day work.[3]

An employer should examine its complete roster against the applicable rules instead of treating the daily overtime figure as its only control. If the proposed pattern appears inconsistent with a statutory limit, seek clarification before normalising that pattern in payroll or a staffing model.

A useful operational review asks whether extra work comes from a temporary delivery peak, poor handover, rework, missing skills or a permanent capacity shortfall. The answer matters because paying a premium does not correct the underlying scheduling problem. Track the cause alongside the cost.

Consider a hypothetical packing team repeatedly staying late because orders reach the warehouse after the dispatch cutoff. More workers may not solve the timing failure. A better handoff from sales could reduce the extra hours. That is a management interpretation, not a legal exemption from paying eligible overtime.

Reconcile the payslip against the register

At payroll close, compare hours submitted, hours accepted, rate used, classification and amount paid. Ask for an explanation of each difference. “Included in salary” is not a complete reconciliation unless the employer explains the relevant entitlement and how the payment satisfies it.

A concise written query is more useful than an accusation: identify the payroll month, list the disputed dates and ask whether the difference concerns hours, eligibility or rate. Attach a short schedule and retain the original supporting records. Give payroll a question it can answer.

If the dispute continues, use the current official MOHRE service route and explain the facts consistently. This article does not impose a waiting period or claim a guaranteed resolution timetable. A case involving a different employment authority needs the correct channel for that employment relationship.

Questions workers and employers ask

Does working late automatically create the night premium?

No single timestamp settles the entire issue. The work must qualify as overtime under the applicable framework, and the official night provision specifically treats shift workers differently. Establish the role, roster and additional period before applying a multiplier.

Should the calculation use the entire salary package?

The official overtime guidance refers to basic wage. Ask payroll to identify the contractual basic component and its hourly conversion. Do not assume the transfer received in a bank account is itself the correct calculation base.

Can a rest day simply be treated as ordinary overtime?

The law provides distinct treatment for contractual rest-day work. Record which rest day was affected, whether a substitute was provided and how the employer calculated any payment. Do not use a weekday example to settle a rest-day question.

What makes a review useful?

A useful review ends with a reconciled amount, an explanation of unresolved differences and a better record for the next pay period. For an Ajman business, that is both a pay-control discipline and a way to see whether delivery demands match available staff. For a worker, it replaces a vague memory of long days with an intelligible account of time and remuneration.
